Acceptance of Terms

By accessing or using DwellVerity (“the Platform”), you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use the Platform.

Service Description

DwellVerity operates an online marketplace platform that connects homeowners, buyers, and real estate professionals with licensed home inspectors for residential property inspection services.

DwellVerity facilitates booking, payment processing, scheduling, and digital report delivery. DwellVerity is a marketplace platform. Inspection quality is the responsibility of the licensed inspector.

By using DwellVerity, you agree to engage with independent third-party inspection professionals. DwellVerity does not perform inspections itself and is not a licensed inspection company.

User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.

User Obligations

  • Provide accurate and complete information when booking an inspection.
  • Ensure property access is available at the scheduled time.
  • Not interfere with the inspector during the inspection process.
  • Pay all fees associated with booked services in a timely manner.
  • Comply with all applicable local, state, and federal laws.
  • Use the platform for lawful purposes only.

Intellectual Property

All content, trademarks, and intellectual property on the Platform are owned by DwellVerity or its licensors. You may not reproduce, distribute, or create derivative works without our express written permission.

Termination

We reserve the right to suspend or terminate your account at any time for violation of these terms, fraudulent activity, or any conduct that we deem harmful to the Platform or its users.

Privacy Policy

Information We Collect

We collect personal information you provide during account creation and booking, including:

  • Name, email address, and phone number — for account creation and communication
  • Property address and details — necessary for scheduling inspections
  • Payment information — processed securely through Stripe; we do not store full payment card details
  • Booking history and preferences — to improve your experience

How We Use Your Information

We use your information solely for:

  • Facilitating and confirming inspection bookings
  • Communicating with you about your bookings, including reminders and updates
  • Processing payments through our secure payment processor (Stripe)
  • Improving our platform, services, and user experience
  • Sending service-related communications (not marketing, unless you opt in)

Data Retention

We retain your personal data only as long as necessary to provide our services, comply with legal obligations, resolve disputes, and enforce our agreements. Booking records are retained for a minimum of three years as required by applicable regulations. You may request deletion of your data at any time.

Third-Party Sharing

We share necessary information with:

  • Inspectors you book — your name, phone number, and property address to perform the inspection
  • Stripe — payment information for transaction processing (subject to Stripe's privacy policy)
  • Service providers — third-party vendors who help us operate the platform (email delivery, analytics)

We do not sell your personal data to third parties. We do not share your data for advertising or marketing purposes.

Cookies

We use essential cookies to operate the Platform, including session cookies for authentication and functional cookies to remember your preferences. We may also use analytics cookies to understand how the Platform is used. You can control cookie settings through your browser preferences.

Data Security

We implement industry-standard encryption (SSL/TLS) and security measures to protect your data in transit and at rest. Access to personal data is restricted to authorized personnel only.

Your Rights

You have the right to access, correct, or delete your personal data at any time by contacting us at privacy@dwellverity.com. You may also request a copy of the data we hold about you.

By using DwellVerity, you consent to the collection and use of information as described in this policy. We may update this policy periodically; continued use of the Platform constitutes acceptance of any changes.

Disclaimer

DwellVerity is a marketplace platform, not an inspection company. We provide the technology and infrastructure to connect homeowners with licensed, insured home inspection professionals.

All inspectors listed on DwellVerity are independent contractors and are not employees, agents, or representatives of DwellVerity. Each inspector is solely responsible for the quality, scope, and accuracy of their inspection services and reports.

DwellVerity does not guarantee the accuracy, completeness, or timeliness of any inspection report. We expressly disclaim any liability for the quality, scope, or findings of any inspection performed by an independent inspector booked through our platform.

The Platform is provided "as is" without warranties of any kind, either express or implied, including but not limited to warranties of merchantability or fitness for a particular purpose.

Users are encouraged to verify an inspector's licensing, insurance, and credentials directly before booking. DwellVerity performs initial verification but does not continuously monitor inspector credentials.

Refund Policy

Cancellation by Homeowner

  • Cancellations made 48 hours or more before the scheduled inspection: full refund, no questions asked.
  • Cancellations made between 24 and 48 hours before the inspection: 50% refund.
  • Cancellations made less than 24 hours before the inspection: no refund. You may reschedule at no additional cost.
  • No-shows without prior notice: no refund.

Cancellation by Inspector

If an inspector cancels, you will receive a full refund and we will help you book an alternative inspector at your preferred time. In some cases, we may offer a credit toward your next booking.

Dispute Resolution

If you are unsatisfied with the quality of an inspection, please contact us at support@dwellverity.com within 7 days of the inspection date. We will mediate between you and the inspector to reach a fair resolution.

If a resolution cannot be reached through mediation, disputes may be submitted to binding arbitration in accordance with the laws of the State of New York. The prevailing party shall be entitled to recover reasonable attorney fees and costs.

All refunds are processed within 5–10 business days and returned to the original payment method.

Limitation of Liability

To the maximum extent permitted by law, DwellVerity shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to the use of the platform or any inspection services booked through the platform.

DwellVerity's total liability for any claims arising under these terms shall not exceed the total amount paid by the user for the specific booking giving rise to the claim.

Users acknowledge that inspectors carry their own errors and omissions (E&O) insurance and that any claims regarding inspection quality should be directed to the inspector.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions. Any disputes arising from these terms shall be resolved exclusively in the state or federal courts located in New York County, New York.

Binding Arbitration Agreement

Agreement to Arbitrate

You and DwellVerity mutually agree to resolve any and all disputes, claims, or controversies arising out of or relating to these Terms, the Platform, or any inspection services booked through the Platform, exclusively through final and binding individual arbitration, rather than in court. This agreement is governed by the Federal Arbitration Act (FAA), 9 U.S.C. § 1–16, and shall be enforceable in accordance with its terms.

Arbitration Rules

Arbitration shall be administered by either JAMS or AAA(American Arbitration Association) under their respective consumer arbitration rules in effect at the time the arbitration is filed. The arbitration will be conducted by a single neutral arbitrator and shall take place in New York County, New York, unless the parties mutually agree to a virtual hearing. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.

Consumer Fee Cap

In any arbitration between you and DwellVerity, DwellVerity will pay all filing, administrative, and arbitrator fees in excess of $250(the consumer's share). If the arbitrator finds that your claim was frivolous or brought in bad faith, the arbitrator may require you to reimburse DwellVerity for fees in accordance with the applicable arbitration rules.

Class Action Waiver

YOU AND DWELLVERITY AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, OR REPRESENTATIVE PROCEEDING.The arbitrator may not consolidate more than one person's claims, and may not preside over any form of class, collective, or representative proceeding. If this class action waiver is found to be unenforceable, then the entire arbitration agreement shall be null and void.

Delegation Clause

The arbitrator, and not any federal, state, or local court or agency, shall have the exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this Arbitration Agreement, including any claim that all or any part of this Arbitration Agreement is void or voidable.

30-Day Opt-Out Right

You have the right to opt out of this Arbitration Agreement within 30 daysof your first use of the Platform by sending a written notice to arbitration-optout@dwellverity.com or by mail to DwellVerity, Attn: Arbitration Opt-Out, 123 Inspection Way, New York, NY 10001. Your opt-out notice must include your full name, email address used for your account, and a clear statement that you wish to opt out of this arbitration provision. Opting out will not affect any other terms of service.

Survival and Severability

This Arbitration Agreement shall survive any termination of your account or the Terms of Service. If any portion of this Arbitration Agreement is found to be unenforceable, the unenforceable portion shall be severed, and the remainder of the Arbitration Agreement shall remain in full force and effect.

Independent Contractor Acknowledgment

All home inspectors, contractors, and service providers listed on DwellVerity (“Inspectors”) are independent contractors, and are not employees, partners, joint venturers, agents, or franchisees of DwellVerity. This relationship is fundamental to the operation of the Platform and is acknowledged by both Inspectors and Clients.

No Employment Relationship

DwellVerity does not control, direct, or supervise the manner or method by which Inspectors perform their services. Inspectors retain sole discretion over their work schedules, inspection methodologies, tools and equipment, pricing (subject to platform guidelines), and the personnel they engage to assist with inspections.

Inspector Responsibilities

  • Obtaining and maintaining all required professional licenses, certifications, and permits.
  • Carrying appropriate general liability, errors & omissions (E&O), and workers' compensation insurance.
  • Paying all applicable taxes, including self-employment tax, income tax, and any business taxes.
  • Providing all necessary tools, equipment, and supplies for performing inspections.
  • Complying with all applicable laws, regulations, and industry standards.
  • Liability for the quality, accuracy, and completeness of inspection reports.

No Benefits

Inspectors are not entitled to any employee benefits from DwellVerity, including but not limited to health insurance, retirement plans, paid time off, sick leave, unemployment benefits, or workers' compensation coverage provided by DwellVerity.

Acknowledgment by Clients

By booking an inspection through DwellVerity, Clients acknowledge that they are engaging an independent contractor, not DwellVerity or any employee thereof, to perform the inspection service. Clients agree to direct any claims regarding inspection quality, scope, or findings to the Inspector directly.

No Joint Venture

Nothing in these Terms or on the Platform shall be construed to create a partnership, joint venture, employment, or agency relationship between DwellVerity and any Inspector. Each Inspector operates as a wholly independent business entity solely responsible for their own business operations and obligations.

Client Agreement

This Client Agreement governs the contractual relationship between the Client (“you”) and the licensed home inspector (“Inspector”) you book through DwellVerity. DwellVerity is not a party to this agreement.DwellVerity provides the technology platform that facilitates the connection, booking, scheduling, and payment processing between Clients and Inspectors, but DwellVerity does not perform inspections and does not act as the Inspector's principal or employer.

Scope of Inspection

The Inspector agrees to perform a home inspection in accordance with the standards of practice established by the applicable state licensing board and the American Society of Home Inspectors (ASHI) or the International Association of Certified Home Inspectors (InterNACHI), as applicable. The scope of the inspection shall be as described in the booking confirmation and any separate inspection agreement entered into between the Client and the Inspector.

Client Obligations

  • Provide safe and reasonable access to the property, including all structural components, systems, and areas to be inspected.
  • Ensure utilities (gas, water, electricity) are operational at the time of inspection.
  • Disclose any known material defects or issues with the property prior to the inspection.
  • Pay all fees as agreed upon at the time of booking through DwellVerity's payment platform.
  • Be present or designate a representative to be present during the inspection, if desired.

No Third-Party Beneficiary

This Agreement is solely for the benefit of the Client and the Inspector. DwellVerity is an intended third-party beneficiary only with respect to payment processing and platform fees. No other person or entity shall have any rights under this Agreement.

Inspection Report

The Inspector shall provide a written inspection report to the Client within the time frame agreed upon (typically within 24–48 hours of the inspection). The report is the exclusive property of the Inspector and is provided for the Client's use only. The report may not be distributed to third parties without the Inspector's written consent.

Dispute Resolution Between Client and Inspector

Any disputes arising between the Client and the Inspector regarding the inspection, report, or any related services shall be resolved directly between the Client and the Inspector. DwellVerity may, at its sole discretion, offer mediation services to facilitate resolution but shall have no obligation to do so. DwellVerity shall not be liable for any disputes between Clients and Inspectors.

Electronic Signature Consent

E-SIGN Act Compliance

By using DwellVerity, you consent to the use of electronic signatures and electronic records in connection with all transactions, agreements, disclosures, and communications made through the Platform. This consent is provided in accordance with the Electronic Signatures in Global and National Commerce Act (E-SIGN Act), 15 U.S.C. § 7001 et seq., and any applicable state laws governing electronic transactions.

Scope of Consent

Your electronic signature applies to, but is not limited to:

  • Acceptance of these Terms of Service and all legal policies.
  • Booking confirmations and inspection service agreements.
  • Payment authorizations and processing consents.
  • Disclosure acknowledgments and waivers.
  • Inspection reports and related documentation.
  • Any amendments or updates to the foregoing.

Hardware and Software Requirements

To access and retain electronic records, you will need:

  • A computer or mobile device with internet access.
  • A modern web browser (Chrome, Firefox, Safari, or Edge, most recent two versions).
  • An active email account for receiving notifications and documents.
  • PDF reader software (such as Adobe Acrobat Reader) to view and print records.
  • Sufficient storage capacity to save electronic records.

Withdrawing Consent

You may withdraw your consent to electronic signatures and records at any time by contacting us at privacy@dwellverity.com. However, withdrawing consent may affect your ability to use the Platform, as certain transactions require electronic signatures. If you withdraw consent, DwellVerity reserves the right to terminate or restrict your access to services that depend on electronic transactions.

Paper Copies

You have the right to receive a paper copy of any electronic record at no charge. To request a paper copy, please contact us at privacy@dwellverity.com with your full name, account email, and a description of the record(s) you need.

Effectiveness of Electronic Signatures

Your electronic signature (including clicking “I Agree,” “I Consent,” or similar affirmative action, or typing your name in a signature field) is legally binding and enforceable to the same extent as a handwritten signature. You agree that you will not challenge the validity or enforceability of any agreement or record on the grounds that it was signed or provided electronically.

State-Specific Disclosures

Depending on the location of your property, certain additional disclosures and notices may apply. Please review the disclosures applicable to your state below.

New York — Right to Home Inspection Notice

Under New York law, home inspections are regulated by the New York State Department of State, Division of Licensing Services. You have the right to request the name and license number of the inspector assigned to your property. New York-licensed home inspectors must provide you with a written inspection agreement before performing any inspection. The inspection report must be provided to you within a reasonable time after the inspection, as specified in your agreement with the inspector.

Florida — Radon Disclosure

Radon Warning: Radon is a naturally occurring radioactive gas that, when it accumulates in a building in sufficient quantities, may present a health risk to persons who are exposed to it over time. Levels of radon that exceed federal and state guidelines have been found in buildings in Florida. Additional information regarding radon and radon testing may be obtained from your county public health unit. DwellVerity recommends that you consider having a radon test performed as part of your home inspection, and you may request an inspector who is certified in radon measurement.

California — Trade Practice Act

In accordance with the California Home Inspection Act (Business and Professions Code § 7195–7199), inspectors operating in California must be licensed by the California Bureau of Real Estate (CalBRE) or be exempt from licensure. Home inspections in California must adhere to the Standards of Practice set forth by the California Home Inspectors Organization (CREIA) or equivalent recognized standards. You have the right to request a copy of the inspector's license and proof of insurance prior to the inspection. California law further provides that an inspection report is not a warranty, guarantee, or insurance policy regarding the condition of the property.

Texas — TREC Disclosure

Home inspections in Texas are regulated by the Texas Real Estate Commission (TREC). TREC requires all inspectors to hold a valid professional license. You may verify an inspector's license by contacting TREC at (512) 936-3000 or visiting www.trec.texas.gov. TREC requires standard forms to be used for inspection reports. The inspection report provided by your inspector will follow TREC's Standards of Practice (22 TAC § 535.220–535.229) and is intended to report the condition of the items inspected at the time of inspection. Inspectors are not required to identify defects that are concealed, latent, or otherwise inaccessible. You are encouraged to attend the inspection, read the report carefully, and ask questions of your inspector.

New Jersey — License Disclosure

New Jersey law (N.J.S.A. 45:8-61 et seq.) requires all home inspectors to be licensed by the New Jersey State Board of Home Inspectors. You may verify an inspector's license by contacting the Board at (973) 504-6480. Licensed home inspectors in New Jersey must adhere to the Standards of Practice and Code of Ethics established by the Board. New Jersey also requires home inspectors to present clients with a consumer information statement prior to entering into an inspection agreement. By booking an inspection in New Jersey, you acknowledge receipt of this disclosure and confirm that you have been advised of your rights under New Jersey law.

General Notice

The disclosures above are provided for informational purposes and do not constitute legal advice. The requirements and regulations governing home inspections vary by jurisdiction. You are encouraged to consult with a qualified attorney regarding your specific legal rights and obligations. DwellVerity makes reasonable efforts to ensure inspectors listed on its platform hold the required licenses for the states in which they operate, but we recommend verifying credentials directly with the applicable state licensing authority.

Insurance Verification Agreement

DwellVerity takes reasonable steps to verify that Inspectors operating on its platform maintain appropriate insurance coverage. This section describes the scope and limitations of DwellVerity's insurance verification process.

Verification Process

At the time of onboarding, each Inspector is required to provide valid certificates of insurance demonstrating at minimum:

  • General Liability Insurance — minimum $1,000,000 per occurrence.
  • Errors & Omissions (E&O) Insurance — minimum $500,000 per claim.
  • Workers' Compensation Insurance — as required by applicable state law.

DwellVerity reviews these certificates to confirm they appear valid, current, and compliant with coverage minimums. Verification is conducted at onboarding and on an annual renewal basis thereafter.

Limitations of Verification

DwellVerity's insurance verification is limited to document review and does not constitute an endorsement, guarantee, or warranty of the adequacy, accuracy, or enforceability of any Inspector's insurance policy. DwellVerity does not:

  • Confirm that an Inspector's policy is in effect at the time of a specific inspection.
  • Verify policy exclusions, deductibles, or coverage limits beyond the certificate provided.
  • Act as a claims administrator or adjuster for any insurance claims.
  • Maintain continuous real-time monitoring of policy status between renewal periods.

Your Responsibility

Clients are encouraged to independently verify an Inspector's insurance coverage by requesting a copy of the certificate of insurance directly from the Inspector or the Inspector's insurance carrier before the inspection. DwellVerity may, upon request, provide copies of the certificates of insurance on file for Inspectors you have booked, subject to Inspector consent.

Inspector Obligations

Inspectors agree to maintain continuous insurance coverage as described above for the duration of their engagement with DwellVerity. Inspectors must notify DwellVerity immediately if their coverage lapses, is canceled, or is materially changed. Failure to maintain required insurance may result in removal from the Platform. Inspectors further agree to indemnify and hold harmless DwellVerity from any claims arising from their failure to carry adequate insurance.

Cookie Policy

This Cookie Policy explains how DwellVerity uses cookies, web beacons, and similar tracking technologies when you visit or use our Platform. By using DwellVerity, you consent to the use of cookies as described in this policy.

What Are Cookies

Cookies are small text files that are placed on your device (computer, tablet, or mobile phone) when you visit a website. They enable the website to remember your actions and preferences (such as login status, language, and display preferences) over a period of time, so you don't have to re-enter them each time you return.

Types of Cookies We Use

Essential (Strictly Necessary) Cookies: These cookies are required for the Platform to function properly. They enable core functionality such as user authentication, session management, and security. Without these cookies, the Platform cannot operate correctly.

  • Session tokens for maintaining login state.
  • CSRF (Cross-Site Request Forgery) protection tokens.
  • Load-balancing session cookies for performance.

Functional Cookies: These cookies remember your preferences and choices to enhance your experience.

  • Language and region preferences.
  • Saved search filters and display preferences.
  • Recently viewed inspectors or properties.

Analytics Cookies: We use analytics cookies to understand how users interact with the Platform, which helps us improve functionality and user experience.

  • Page visit counts and navigation patterns.
  • Search behavior and booking flow analytics.
  • Error tracking and performance monitoring.
  • Aggregated demographic data (no personal identification).

Marketing Cookies (Opt-In): These cookies are used only with your explicit consent. They help us deliver relevant content and measure the effectiveness of our communications.

  • Social media sharing functionality.
  • Referral tracking for partner programs.

Third-Party Cookies

Some cookies on the Platform are placed by trusted third parties. We use:

  • Stripe — for payment processing functionality (Stripe's own privacy and cookie policies apply).
  • Vercel Analytics — for anonymized traffic analytics (no personal data collected).

Cookie Duration

Cookies may be “session cookies” (which expire when you close your browser) or “persistent cookies” (which remain on your device for a set period or until you delete them). Our essential and functional cookies generally persist for up to 12 months, while analytics cookies typically persist for up to 24 months. You can clear or block cookies at any time through your browser settings.

Managing Cookies

Most web browsers allow you to control cookies through their settings preferences. You can:

  • Block all cookies or third-party cookies.
  • Delete all cookies when you close your browser.
  • Receive a notification when a cookie is being set.
  • Whitelist specific websites for cookie acceptance.

Please note that blocking essential cookies may affect the functionality of the Platform and may prevent you from using certain features, including booking inspections and accessing your account.

Updates to This Policy

We may update this Cookie Policy from time to time to reflect changes in technology, regulation, or our practices. When we make material changes, we will notify you by email or through a prominent notice on the Platform. Your continued use of the Platform after such changes constitutes your acceptance of the updated policy.

California Privacy Rights (CCPA/CPRA)

This section supplements the information contained in our Privacy Policy and applies solely to California residents as defined by the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (CPRA)(collectively, the “CCPA”). Any terms defined in the CCPA have the same meaning when used in this section.

Categories of Personal Information We Collect

In the preceding 12 months, we have collected the following categories of personal information:

  • Identifiers: name, email address, phone number, IP address, account username.
  • Commercial information: booking history, inspection records, payment transactions.
  • Geolocation data: property address and general location data.
  • Professional or employment-related information: for inspectors: license information, credentials, insurance details.
  • Internet or other electronic activity: browsing behavior, interactions with the Platform.

We do not sell personal information, and we have not sold personal information of any California resident in the preceding 12 months. We do not share personal information for cross-context behavioral advertising.

Your Rights Under the CCPA

If you are a California resident, you have the following rights:

  • Right to Know: You may request that we disclose the categories and specific pieces of personal information we have collected about you, the categories of sources from which the information was collected, the business purpose for collecting the information, and the categories of third parties with whom we share the information.
  • Right to Delete: You may request that we delete any personal information we have collected about you, subject to certain exceptions (e.g., completing transactions, detecting security incidents, complying with legal obligations).
  • Right to Correct: You may request that we correct inaccurate personal information that we hold about you.
  • Right to Opt-Out of Sale/Sharing: We do not sell or share personal information as defined by the CCPA. However, you have the right to opt out of any future sale or sharing at any time.
  • Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights. This means we will not deny services, charge different prices, or provide a different level of service based on your exercise of CCPA rights.
  • Right to Limit Use of Sensitive Personal Information: We do not collect or process sensitive personal information for purposes other than those permitted under the CCPA.

Categories of Personal Information Disclosed for Business Purposes

In the preceding 12 months, we have disclosed the following categories of personal information for business purposes:

  • Identifiers — disclosed to Inspectors (for booking fulfillment) and Stripe (for payment processing).
  • Commercial information — disclosed to Inspectors and Stripe as necessary for transaction processing.
  • Geolocation data — disclosed to Inspectors for scheduling and performing inspections.

How to Exercise Your Rights

To exercise any of your CCPA rights, please submit a verifiable consumer request to us by:

  • Emailing privacy@dwellverity.com with the subject line “CCPA Request”.
  • Submitting a request through our CCPA Rights Request Form (available in your account settings).

Only you, or a person authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request.

We will acknowledge receipt of your request within 10 business days and respond substantively within 45 calendar days. If we require additional time (up to 45 additional days), we will inform you of the reason and extension period. You may designate an authorized agent to make a request on your behalf by providing written authorization signed by you.
